The Supreme Court held that although the book was subject to copyright, the bookkeeping method itself was not a suitable subject of copyright, and because the forms were merely implements for performing the method, they were not copyrightable subject matter. His book met with little success, but when another publisher began successfully selling a book containing very similar forms, his widow filed a copyright infringement suit. Selden,4 the plaintiff had developed a new method of bookkeeping and published a book containing an introduction, an explanation of the method, and some examples that consisted mostly of blank bookkeeping forms. To discuss copyright in board games, we must look back to an 1879 Supreme Court case ironically having nothing at all to do with games. For the most part they have the same mechanics but with different language on their cards.įound this on the American Bar Assoc website, article was from 2015 Why games like apples to apples, cards against humanity, superfight and so on can continue to be distributed and sold. When it comes to game mechanics, copyright laws are no help. It hurts that they have profited off so well and claimed ownership of something that I worked so hard on. I can’t find much about the company other than that it’s owned by a guy named ‘Alex’ and they were registerd in New York in 2019.ĭoes anyone know if there is anything I can do about this? Their instagram is equally empty and strange along with all other online presence. The company have a terrible and very incomplete website filled with ‘Loren ipsum…’.

Especially after working so hard on very little to get up to just 31 5 star reviews myself :( It seems obvious to me that they took the same idea and changed it so that they wouldn’t get caught and reading the 3,670 reviews on amazon makes me really honestly sad and very angry. The game features 125 cards (many of which’s text are copied but changed slightly) and 5 categories : Decree, Activity, Skill, Curse & Secret. In around 2019 a new game was released called ‘Sotally Tober’ by a company called ‘Parti Profi’. The game is quite simple as you just draw cards and do what they say but what makes the game unique and fun is the 5 category cards : Rule, Action, Power, Weakness & Special which I had never seen before my game. The game took me years to create and includes 200 unique cards all individually hand drawn by my friend and co-founder. So I created my party card game called Drink Drank Drunk back in 2017 and successfully kickstarted it in 2018.
